    My Lawsuit Against CSC Credit

    CSC Credit Services is an affiliate of Equifax. In my State, CSC Manages my Equifax Credit file. That being said, I wanted to post all about a Law Suit I am still engaged in with CSC.

    To begin, about 3 months ago, I noticed that 2 of my credit card accounts listed on my CSC (Equifax) report were not being listed with the correct credit limits. Easy enough, I got out my most recent statements from the credit card companies and faxed them the CSC along with a dispute letter requesting that they update the two items to reflect the true and accurate credit limit amounts per the billing statements from the credit card companies themselves.

    30 Days later, I got a notice from CSC stating that they had completed the investigation and that "we have verified with the original creditor that the credit limit currently on record is correct and no changes would be made."

    The credit report still showed the incorrect credit limit amounts and CSC put it in writing that they were not going to change the items.

    I found this to be quite disturbing since I had sent CSC copies of billing statements directly from the credit card companies themselves which showed a credit limit that was not the same as what was listed by CSC on my credit report. Basically, I sent them proof positive directly from the original creditor that there were inaccurately listed items on my credit report. Yet CSC apparently ignored this fact and claims to have contacted the original creditor.

    I thought about all of this for a while and then decided to send a demand letter, explaining the situation and giving them 10 days to fix their mistake and to pay me for that mistake.

    They ignored that letter, at least initially. (More on that later)

    So, I filed a Small Claims suit against them for violations of the FCRA and for violations of Texas Law as well (Texas has some neat credot reporting laws that specify "statutory" damages...meaning that you don't have to prove actual damages...like a speeding ticket, violate the law, pay the fine, even though no one got hurt)



    It took about a week for them to be served with the lawsuit, but the day they were served, I got a call from their Lawyer.

    He claimed I could not sue them because they were still investigating. I asked him how that could be since I had in my hand a letter from them stating they had completed their investigation.

    He said they were investigating based upon my demand letter. So I said "you mean the one that gave you 10 days to fix your original mistake or face a lawsuit?" He was not sure what to say.

    He then offered to settle this matter by deleting the accounts and "cloaking" them so they did not show backup. My response was "Hell no, don't delete them" because they are long term positive accounts that have never ever had a bad mark on them. Deleting these accounts would hurt my credit, not help it.

    He then asked my what I would propose. I of course told him I wanted to be compensated for their violations of Texas and Federal Law, and that I wanted him to update the accounts to show the true and correct credit limits.

    He said he could update them to the correct amount as I requested, but could not guarantee that they woulds stay accurate and that was because when the original creditor updated the items each month, they might change back to the incorrect amount.

    So I said "are you telling that you can not ensure the accuracy of the items in credit reports?" And I then asked him if he thought I shoudl call the FTC because of his admission that CSC could not ensure maximum possible accuracy of credit reports. After all I said, the law says that is the duty of CSC to ensure maximum possible accuracy and you are telling me that you can't even ensure accuracy of an item for which you have been provided definitive proof about?

    His reponse was that that was "not really what he meant."

    So I aksed him what it was that he really meant? he then asked me again what it woudl take to settle this here and now?

    I told him again and he asked me to fax him a settlement offer.

    So I did, and I copied the court on everything.

    The very next day, I get a letter from CSC stating they have completed their "investigation." Lo and behold, instead of those two accounts listing the correct credit limits, they had the notation of "Contact MBR for Status." No Balance, No Limit, No Terms, No Status, nothing, just the account number and that notation. Credit score dropped by 35 points.

    So I called their lawyer and asked him WTF? He said that was the best he could do. I said that that notation is NOT accurate and they KNOW it. That qualifies as "Willful Non-Compliance" with the law and if they did not change it as I have requested and settle per my previous offer to settle, I would also file a new suit for Willfull non-compliance with the Law an hold him personally resposible on criminal charges as well.

    He said he would call me back but I have not heard from him in over a week. My Court date is August 9th.

    I will keep everyone up to date as new developments occur and I will try to cut and paste my court filings and such as soon as I have time.

    DANG!!!

    My ONLY remaining situation on all 3 of my reports emulates, almost exactly, Bull's problem, with only 1 difference.

    1) CBC, EQ. affiliate in Ohio DELETES/SUPRESSES my TL after I did EXACTLY the same thing Bull did here, and in this exact same order too.

    I already have my letter from the OC stating they ARE reporting, and just today I get a letter from EQ. saying they are NOT reporting.

    Federal case ensues.

    I'm really bummed because the link is dead. How did Bull do on this case?

    I just fixed the link - everybody who finds bad links please REPORT them.

    I think bullforever settled with a non disclosure agreement.

    Bull could have stopped by long enough to say that yes he was happy with what happened, without violating a conf. agreement.

    What a bummer.

    Sorry, I know NOTHING about php, didn't think I could save any of the forum. Was thrilled that Donna made the threads work.

    Search, print, all that stuff doesn't work. And, I'm not about to hire someone to fix it - that's not in the budget.
